Action Taken By the Authority Against Unauthorised Development

PROVISION NO. 20.3

The Chief Executive Officer (CEO) or any other official authorised by him is entitled to:

  1. Demolish the building you (the builder) constructed and charge you a fee for it.
  2. Take suitable  action against the Technical Person responsible.
  3. Commence criminal proceedings against you.

In July 2020, the Uttar Pradesh government sought to implement the Compounding Scheme, 2020, which allowed owners of unauthorised constructions to legalise their properties by paying a fee. However, in October, 2020, the Allahbad High Court stayed the execution of the scheme, stating that such a scheme would cause substantial damage to the objective of planned development.
