SECTION NO. 5.0
The promoter or an apartment owner may be prosecuted for violation of violation of the provisions of the Uttar Pradesh Apartment (Promotion of Construction, Ownership and Maintenance) Act, 2010 or the bye-laws. However, such violations can only be prosecuted with prior written permission of vice chairman of the respective development authority or district collector.
The violations for which a promoter can be prosecuted is detailed in Section 25 of the Uttar Pradesh Apartment (Promotion of Construction, Ownership and Maintenance) Act, 2010
Such written application can only be made by the Board of Management of an Association of Apartment Owners elected by its members under the bye-laws.
